Terms of Service

1. Acceptance of Terms

By accessing or using the Yogyer platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of the terms, you may not access the Service.

2. Service Description

Yogyer is a platform that allows yoga instructors to upload videos, sell workshops, and offer online classes to students. The Service includes all aspects of the Yogyer platform.

3. User Accounts

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. Content

Users retain all ownership rights to the content they upload. By uploading content, you grant Yogyer a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute that content in connection with the Service.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating laws or regulations
  • Infringing intellectual property rights
  • Uploading malicious content
  • Impersonating others
  • Interfering with the proper functioning of the Service

6. Payments and Subscriptions

Certain aspects of the Service may be paid features. You agree to pay all fees associated with your use of the Service. Subscriptions will automatically renew unless canceled in advance.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach the Terms.

8. Limitation of Liability

In no event shall Yogyer, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

10. Data Processing Agreement (GDPR Art. 28)

In providing the Service, the instructor acts as the data controller for their students' personal data, and Yogyer acts as the data processor on the instructor's behalf, under Article 28 of Regulation (EU) 2016/679 (GDPR). This section constitutes the data processing agreement between the two parties:

  • Subject matter, duration, nature and purpose: the subject matter is the provision of the Service (content hosting, student management, analytics, and billing); it lasts for as long as the contractual relationship between the instructor and Yogyer continues; its nature is the storage, processing, and retrieval of personal data on the platform; its purpose is to allow the instructor to manage their students, content, and sales.
  • Type of data and categories of data subjects: we process identification, contact, payment (handled by the payment gateway), and platform usage data belonging to the instructor's students.
  • Confidentiality: personnel authorized to process the data have committed to confidentiality or are under an appropriate statutory obligation of confidentiality.
  • Security measures (GDPR Art. 32): we implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including encryption in transit, access controls, and per-organization data isolation.
  • Sub-processors: we engage the following sub-processors to provide the Service: Neon (database), Vercel (hosting), Stripe (payment gateway), and Vimeo (video hosting). We will give the instructor advance notice of any intended change to this list, with the opportunity to object.
  • Assistance to the controller: we assist the instructor, insofar as reasonably possible, in fulfilling their obligation to respond to requests from students exercising their rights (access, rectification, erasure, objection, among others).
  • Deletion or return of data: at the end of the provision of the Service, we will delete or return, at the instructor's choice, all personal data processed, unless retention is required by law.
  • Audits: we will make available to the instructor the information necessary to demonstrate compliance with this section, and will allow for and contribute to audits, including inspections, conducted by the instructor or an auditor authorized by them.
